Rep. Jamie Raskin (D-MD) stated that he firmly believes ex-President Donald Trump is banned from running for the presidency due to his involvement in the 2021 Capitol attack, The Hill reported.
Raskin’s statement came in response to a question from CNN's Dana Bash on her show "State of the Union". Bash asked if Raskin concurred with GOP presidential candidate Asa Hutchinson‘s view that the 14th Amendment could disqualify Trump from a presidential bid.
"Well, absolutely and we've been saying all along that Section 3 of the 14th Amendment presents a clear and unequivocal statement”, said Raskin. He emphasized that this rule applies not just to the president, but also to members of Congress and other federal officeholders who engage in insurrection or rebellion.

The 14th Amendment stipulates that anyone who has “engaged in insurrection or rebellion” or has supported the enemies of the state, cannot seek presidency. This amendment was added to the Constitution after the Civil War, Raskin explained.
Raskin further noted that the House of Representatives impeached Trump for inciting an insurrection against the union and a majority of senators determined that Trump had incited an insurrection.
Earlier this month, Trump was indicted on four federal charges related to his alleged attempts to overturn the 2020 election that led to the Capitol riots on Jan. 6.
