Trump Requests Recusal Of Tanya Chutkan In 2020 Election Subversion Trial, Seeks An 'Entirely Impartial' Judge

Former U.S. President, Donald Trump, has called for Judge Tanya Chutkan to recuse herself from the federal case involving his alleged attempts to subvert the 2020 election.

What Happened: Trump, in a recent court filing, has argued that Judge Chutkan’s remarks related to the January 6 Capitol riot may lead people to think she has preconceived notions about his case and his purported accountability, as reported by CNN.

Trump contends that a completely impartial judge should oversee the trial to ensure the public accepts the outcome as fair.

“Only if this trial is administered by a judge who appears entirely impartial could the public ever accept the outcome as justice,” said Trump in a court filing on Monday.

Judge Chutkan, an Obama administration appointee, has been outspoken about the Capitol attack, terming it an attack on American democracy. She has handled civil litigation concerning the January 6 incident and has criticized Trump’s efforts to prevent the House select committee from accessing his White House records.

The call for Judge Chutkan’s recusal is not a first for Trump. He has previously requested other judges to step down from cases, citing potential bias due to their political affiliations. These requests have largely been denied.

Why It Matters: Judge Chutkan has a prolonged history with with Trump. She presided over a hearing in 2021 that granted the group investigating the January 6 Capitol Riots access to documents from Trump’s time in the White House. In a ruling, she stated that “Presidents are not kings, and Plaintiff is not President.”

Trump has previously berated Judge Chutkan on his Truth Social platform, alleging her of running an “election interference”.

Recently, Judge Chutkan presided over a hearing related to a protective order request by prosecutors in Trump’s 2020 election conspiracy case. The request aimed to prevent Trump from publicly disclosing evidence shared by the government.
