, today announced its successful assertion of a patent related to its VCSEL technology used in datacenter, enterprise network and high-performance computing applications. On Friday, December 13, 2013, the International Trade Commission issued the Initial Determination finding a violation of Section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. § 1337, in favor of Avago Technologies, upholding the validity of Avago's patents and finding that both Mellanox

and FCI infringe Avago's intellectual property by importing and selling optical communication products having vertical-cavity surface-emitting lasers (VCSEL). The VCSEL products at issue are commonly used in optical communications systems, including components such as Active Optical Cables (AOC) and transceivers that allow digital information to be converted into light and sent through a fiber into a receiver, which then transforms the light back into digital information. The infringing Mellanox AOCs and transceivers are used in InfiniBand and Ethernet adapters, switches, routers, servers, external storage systems and supercomputers.
