Green Light For Cannabis Licenses On The Horizon As Alabama Regulator Resolves Disputes

A Hail Mary attempt by the judge overseeing multiple lawsuits against the Alabama cannabis regulator around its two failed attempts to issue medical cannabis licenses seems to be working out.

The Alabama Medical Cannabis Commission (AMCC) has successfully resolved a majority of the issues raised by license applicants this week following a day of closed-door negotiations prompted by the judge, according to WSFA in Montgomery.

The settlement - which puts an end to numerous legal actions against the regulatory body - is now pending AMCC’s Nov. 27 meeting to get ratified. Alabama Always LLC, Medella LLC, and Chicago cannabis giant Verano Holdings Corp. VRNO VRNOF have been in legal spats with the commission for months.

If approved, the settlement would allow the AMCC to move forward with its medical cannabis license allocation timeline and third attempt to do so, in December. That is if Montgomery Circuit Court Judge James Anderson lifts his stay on awarding the licenses.

So far, the commission failed to award licenses on two occasions, in June and August.

Some of the terms of the settlement include:

  • Discarding the scores from the initial applications, which were generated by evaluators hired by the University of South Alabama administered the scoring system under contract from the AMCC;
  • Dismissing the legal actions brought by plaintiffs that build their cases on those scores as well as issues raised around the instructions AMCC provided to applicants on how to apply, including the file size limit for attachments to their online applications; and
  • All applicants, excluding those in the integrated licensing category, can submit videos and briefing materials again before the commission begins a fresh round of discussions and license allocation.
