The ongoing custody battle between Elon Musk and Claire Boucher, professionally known as Grimes, has taken a significant turn as court records reveal that their three children have been ordered to remain in California.
What Happened: Musk and Grimes, who share three children — X, aged three, and Exa and Tau, aged one — are embroiled in a contentious custody dispute.
Grimes initiated legal action by filing a parental-rights lawsuit in San Francisco Superior Court on Sept. 29. Her request to the court seeks physical custody of the children and joint legal custody with Musk.
On the other hand, Musk reportedly filed legal action in Texas three weeks prior, aiming to establish a parent-child relationship with the children.

Now, court documents have revealed that both parents have obtained “standard restraining orders” prohibiting the removal of children from California without a court order or written permission from all parties.
Musk’s Texas suit also includes a similar order that prevents either parent from altering the children’s residence or disrupting their schooling or daycare arrangements.
However, a significant point of contention revolves around the children’s primary residence.
Musk asserts that the children’s primary residence is in Austin, Texas, stating that they officially moved there at the beginning of 2021. He claims to have had care and possession of the children since their birth, including when they all resided together in Texas.
In contrast, Grimes disputes Musk’s claims, asserting that the children have primarily lived with her in California since the start of 2023.
The children’s actual residence is crucial in determining custody arrangements. If the parents cannot agree on this, the two-state courts may convene to decide the best environment for the children, the report noted.
Currently, the whereabouts of Musk and Grimes’ children remain uncertain, adding further complexity to the ongoing custody battle.
Why It’s Important: It is worth noting that on Sep. 7, Grimes reportedly posted a message on social media platform X (formerly Twitter) in which she asked Musk to “let me see my son or plz respond to my lawyer.”
A week later, Musk brought their eldest child, X, along to his meeting with Recep Tayyip Erdoğan, President of Turkey, in New York, informing the world leader that he “mostly” took care of X.
