Trump Files Motion Seeking Dismissal Of Georgia Election Case Charges

Former U.S. President Donald Trump has initiated his first move to counter charges against him in the Georgia election interference case, NBC News reported.

Trump’s legal team has submitted multiple motions aiming to dismiss the accusations. These charges are linked to alleged attempts to overturn Trump’s 2020 election loss in Georgia.

The motions filed by Trump’s attorneys mirror arguments previously made by his 18 co-defendants, who are accused of transgressing Georgia's Racketeer Influenced and Corrupt Organizations (RICO) Act and other crimes.

In one case, Trump’s lawyers backed a motion submitted by Kenneth Chesebro, accused of devising the legal groundwork for the so-called fake electors scheme. In the motion, Chesebro requested the dismissal of the case against him, arguing that the U.S. Constitution’s Supremacy Clause prevents states from prosecuting conduct “that was entirely within the ambit of federal authority.”

Trump’s attorneys argue that this constitutional reasoning applies to the racketeering and conspiracy-related charges against Trump. Similar approaches were taken regarding motions filed by former Trump attorney Rudy Giuliani.

Despite attempts to move the case to federal court, Trump faces 13 criminal counts in the 41-count indictment. All defendants have pleaded not guilty. The trial is scheduled to commence next month.
