Alabama Judge Amends Cannabis Licensing Restraining Order
Montgomery Circuit Judge James Anderson has amended a temporary restraining order that halted the ongoing medical cannabis licensing process undertaken by the Alabama Medical Cannabis Commission (AMCC), reported the Alabama Reflector.
Judge Anderson initially initiated the restraining order in August. "The court is concerned about how long this process is taking," he said back then. "This is something that needs to move along."
As per Wednesday's amended restraining order, the state cannabis regulator is allowed to move the licensing process forward for cultivators, transporters and labs.
Meanwhile, the AMCC is in a legal spat with several medical cannabis companies that sued the commission for its faulty allocation process.
At its upcoming meeting, the commission intends to revoke licenses granted to dispensaries, processors and integrated facilities, which are companies that produce medical cannabis from seed to sales.
Legal Challenges Ahead? New Hampshire's State-Run Cannabis Experiment
In August, New Hampshire Governor Chris Sununu (R) signed a bill creating a commission to develop legislation for state-operated cannabis stores. Initially centered on studying state-run cannabis stores, the bill gained traction and a subsequent amendment now requires the commission to draft a comprehensive legalization proposal based on their findings.
On Thursday, a representative of the state attorney general's office, who is one of 19 members of the state Commission to Study With the Purpose of Proposing Legislation, State-Controlled Sales of Cannabis and Cannabis Products, discussed the unique legal considerations that could be a result of the state-run sales model, reported Marijuana Moment.
According to Myles Matteson, the head of the criminal justice bureau at the attorney general's office and a senior assistant attorney general, New Hampshire's choice to chart an entirely new path in its cannabis regulatory regime may lead to scrutiny, including both federal criminal prosecution and civil lawsuits, even though no state-level regulatory system is entirely free from liability.
