ParkerVision, Inc. (OTCQB:<a class="ticker" href="https://www.benzinga.com/stock/PRKR#OTCQB">PRKR</a>) today announced that the United States Court of Appeals for the Federal Circuit (&quot;CAFC&quot;) has scheduled November 6, 2023 for oral arguments in ParkerVision v. Qualcomm (Case No. 2022-1755). ParkerVision (the &quot;Company&quot;) filed its notice of appeal in April 2022 following a summary judgment ruling by the U.S. District Court in the Middle District of Florida (Orlando Division) in the Company&#39;s patent infringement case against Qualcomm (Case No. 6:14-cv-00687).

ParkerVision Announced Oral Arguments In ParkerVision Vs. Qualcomm Scheduled For November 6, 2023

ParkerVision, Inc. (OTCQB: <a class="ticker" href="https://www.benzinga.com/stock/prkr#OTCQB">PRKR</a>) today announced that on March 9, 2022, the District Court in Orlando, Florida ruled on one of the outstanding pre-trial motions in the Company's patent infringement case against Qualcomm (Dkt. 682). The court order, which is sealed "for attorney's eyes only" grants Qualcomm's motion to strike (Dkt. 491 in Case no. 6:14-cv-00687 U.S. District Court Middle District of Florida) and excludes opinions of the Company's experts regarding alleged infringement and validity issues.
Because this order is under seal, the Company does not yet have access to it and litigation counsel is unable to share the specific contents of the order with the Company. Nonetheless, ParkerVision and its litigation counsel disagree with the Court's order excluding opinions of the Company's experts related to infringement and validity issues and are evaluating their options. This case has additional outstanding pre-trial motions, including a motion for summary judgment for non-infringement and invalidity filed by Qualcomm (Dkt. 494) and a motion for summary judgment filed by ParkerVision related to IPR estoppel.
ParkerVision CEO Jeffrey Parker commented, "Unfortunately, this order was issued under seal meaning no one outside of counsel can see the content of the actual written order. Likewise, the motion on which this order was based is heavily redacted due to purportedly confidential Qualcomm information. We are working diligently with our litigation counsel to understand the implications of this order and to determine the best course of action moving forward."

Orlando Court Granted Qualcomm Motion Blocking ParkerVision's Presentation of Key Evidence in Pending Infringement Trial

ParkerVision, Inc. (OTCQB:<a class="ticker" href="https://www.benzinga.com/stock/PRKR#OTCQB">PRKR</a>)&nbsp;announced today that the United States District Court for the Western District of Texas has concluded its claim construction, or&nbsp;Markman, hearings, in ParkerVision&#39;s second patent infringement action against Intel (Case no. 6:20-cv-00562). Based on the Court&#39;s rulings, which are expected to be adopted in a final order, the Court ruled in favor of ParkerVision&#39;s proposed constructions for the majority of the terms in dispute in the litigation.
Consistent with its standard practice, the Court issues preliminary rulings on the disputed claim constructions in advance of a Markman hearing. The Markman hearing is then held for the purpose of allowing the parties to present arguments with regard to any of the Court&#39;s rulings that they wish the Court to reconsider. The Court held two Markman hearings in this case, the first on June 24, 2021 and the second on July 22, 2021. Based on the Court&#39;s decisions at the hearings, the Court is expected to adopt all of the Court&#39;s preliminary rulings as its final construction of the disputed terms.
This represents the Company&#39;s second favorable Markman decision against Intel this year. In January 2021, the same Texas court issued a Markman order in the Company&#39;s first patent infringement case against Intel (Case no. 6:20-cv-00108). In both cases, ParkerVision alleges the unauthorized use of ParkerVision&#39;s patented technologies in Intel wireless products.

Mr. Parker continued, &quot;Some of the patents in the two Intel actions were also asserted in an infringement action against Buffalo, Inc. of Japan that was recently resolved through a patent license and settlement agreement. We have additional actions pending against TCL, Hisense, Zyxel, and LG in the same venue where many of the same patents are asserted.&quot;
