According to court documents, on November 15th, 2012, a St. Clair County woman filed a lawsuit in St. Clair County Circuit Court (case no. 12-L-616) alleging Fosamax makes exaggerated claims of its benefits. Fosamax, manufactured by Merck, belongs to the class of drugs known as bisphosphonates. It was approved by the FDA in 1995 and developed to treat post-menopausal osteoporosis and Paget's disease of bone. In the lawsuit plaintiff claims that Fosamax, instead of reducing the possibility of bone fractures, actually increases the risk of injury.
On October 31st, 2012, an Illinois woman and her husband filed a lawsuit in New Jersey District Court (case no. 3:2012cv06770) alleging she suffered a low energy femoral fracture from her use of osteoporosis drugs, Fosamax and Actonel.
Court documents indicate that as of December 22nd, 2012, more than 2,000 lawsuits were pending in the Fosamax Multicounty Litigation in New Jersey Superior Court (No. 282). Plaintiffs claim they suffer femur fractures, jaw problems or other injuries from taking the drug.
Results of the study published in June 25th, 2012, by the Journal of the American Medical Association Internal Medicine (formerly Archives of Internal Medicine), concluded that atypical femoral fractures were associated with bisphosphonate use; longer duration of treatment resulted in augmented risk.
