Diesel eBooks filed an antitrust lawsuit Friday, March 14th against Apple and five publishers claiming its price fixing, already proven in court by the U.S. Department of Justice, has artificially restrained the ability of Diesel eBooks to compete in the market. HarperCollins, Hachette, Macmillan, Penguin and Simon & Schuster are also named in the suit filed in federal court in Manhattan under case number 14-6V-1768.
Diesel eBooks is represented by the law firm Blecher Collins Pepperman & Joye, attorney Maxwell M. Blecher, attorney Jordan L. Ludwig. The suit claims the anticompetitive agreement between the defendants resulted in an agency contract forced upon Diesel eBooks and has precluded it from competing by offering lower prices or retail innovations to consumers.
The allegations of the complaint assert that the publishers shift to the agency pricing model eliminated Diesel eBooks control over pricing thus preventing it from offering bundling, reward programs, general discounting and other tools to effectively compete.
