On December 19, 2013, Pennsylvania dog attack lawyer, Thomas J. Newell, filed a 27 page Complaint in the Dauphin County Court of Common Pleas versus the owner of 3 boxers. In Case #2013-CV-11100CV, Attorney Newell alleged facts of the November 21, 2012 dog attack. A woman, whose company makes home deliveries for Federal Express, went to a private residence in the 300 block of Berry Mountain Road in Millersburg, Dauphin County, PA. As she was walking up the Defendant's driveway to deliver the package, the Defendant's three unrestrained boxers came running down his driveway in full pursuit of the Plaintiff.

As alleged in Attorney Newell's Complaint, one of the boxers jumped up and ripped the package out of her hands. As it fell to the ground, the 3 boxers fought over it and the woman tried to escape. Before she was able to safely reach her truck, the unchained and unsupervised dogs surrounded her and bit her multiple times throughout her body, including her left calf, left thigh and buttocks. The Defendant then came running out of his house to stop this unprovoked attack.

This court document identifies charges filed by the Commonwealth of Pennsylvania versus the Defendant for violating the Pennsylvania Dog Law and the Pennsylvania Rabies Prevention and Control in Domestic Animals and Wildlife Act. The Hearing on those charges took place on January 10, 2013 in Dauphin County before The Honorable Rebecca Jo Margerum. At the Hearing, the Plaintiff, the Defendant and the Pennsylvania Dog Warden, Michael Zeigler testified. The Defendant himself stated that the victim was “distraught and scared” at the time of the attack. At the conclusion of the Hearing, Judge Margerum found the Defendant guilty of failing to confine his dogs and failing to have the 3 boxers properly vaccinated for the rabies virus. The Defendant did not file an appeal from the Judge's ruling.

“In addition to a claim for personal injury damages, my Complaint requests an award of punitive damages versus this dog owner,” said Attorney Newell. “I have alleged in my Complaint three separate occasions where this dog owner acted recklessly by failing to meet his obligations under the Pennsylvania Dog Law and the Pennsylvania Rabies Prevention and Control in Domestic Animals and Wildlife Act, thereby putting delivery personnel, such as my client, in physical danger. This is a situation that could have easily been avoided had the Defendant complied with the requirements of Pennsylvania Law as the vast majority of responsible dog owners do each and every day here in Pennsylvania.”
