Michigan Auto Law Attorney Recovers a $2.55 Million Verdict for Estate of an Elderly Man Who Was Killed in Macomb County Truck Accident

Secura insurance company only offers $250,000 before trial for the death.

Michael Shekoski, 83, was riding his bicycle at 22 Mile Road and Van Dyke when he was run over and killed by an Allied Excavation commercial truck (Theresa Modzelewski-Shekoski, PR of the Estate of Michael Raymond Shekoski v. Michael Garrett Bindig and Allied Excavation, Inc., case no. 10-1959-NI). The truck driver never saw Mr. Shekoski, according to the trucker's testimony in court and the police report.

"What was notable about the case was that Secura Insurance only offered $250,000 to settle this wrongful death truck accident claim," according to Steven M. Gursten, attorney for the estate of Mr. Shekoski and head of Farmington Hills-based Michigan Auto Law. "Instead, Secura Insurance took the stance that the life of a man in his mid-eighties isn't worth very much money."

But on Nov. 15, 2012, attorneys Steven Gursten and Thomas James received a $2.55 million jury verdict for Mr. Shekoski's family in Macomb County Circuit Court, according to a verdict form signed by the jury.

"I take cases to trial because my personal sense of right and wrong is offended, and I wanted a jury as the protectors of our community to remind these insurance companies like Secura about the value of life and what life and suffering are worth," Gursten said. "Sometimes these cases are worth a lot more than what some insurance companies say they are."

Mr. Shekoski is survived by his 10 children, 38 grandchildren and 18 great-grandchildren.
