Recent legislation and proposals demonstrate Iceland's unwillingness to separate tobacco-containing products such as traditional cigarettes, heated tobacco, nicotine products, e-cigarettes and nicotine pouches in the legal regime.

Though the country has two sets of regulations, one for tobacco and one for nicotine-containing products, in practical terms the regulatory approach is very similar.

Restrictions for the nicotine category very much follow the rules for traditional tobacco - for example, in advertising and retail channel restrictions. There are also stricter rules on notification, very much in line with the EU Tobacco Products Directive (TPD), although Iceland is not an EU member state.

Iceland has seen a decline in the number of smokers, so newer tobacco products could be seen as a risk to what the country considers a successful policy. Its inclination towards stricter control of nicotine products appears to suggest a determination to reduce the number of consumers in this area as well.

It can be expected that by the end of 2021 nicotine pouches will be regulated and subject to similar restrictions to those on other products containing nicotine, like e-cigarettes and refills. The Icelandic government has not disclosed any plans to specifically regulate heated tobacco products. There is, however, a possibility that this will change as a result of the EU's coming revision of the TPD, which Iceland has shown compliance with.
