On July 14, 2015, the U.S. Department of Justice on behalf of the U.S. Environmental Protection Agency ("EPA") filed a lawsuit against Navistar alleging that the Company violated the federal Clean Air Act in 2010 by introducing into commerce approximately 7,750 heavy-duty diesel engines that did not meet the EPA's emissions standards applicable to 2010 engines. The lawsuit seeks injunctive relief and civil penalties of up to $37,500 per day for each violation.
KSF's investigation is focusing on whether Navistar and/or its officers and directors violated state or federal securities laws.
