More than 1,600 Mirena lawsuits (http://www.mirenalawsuit2014.com/ ) that allege similar complications of the IUD are now pending in a consolidated litigation underway in New Jersey, Bernstein Liebhard LLP reports.

According to a Case List posted on January 13th, 1,624 claims have now been filed over the birth control device in Bergen County Superior Court. Among other things, plaintiffs involved in these Mirena lawsuits allege Bayer Healthcare Pharmaceuticals' failure to adequately warn about complications that may follow implantation of the IUD. The litigation's update in January is the latest to depict its continued progress. (In Re: Mirena Litigation; Case No. 297)

Mirena Lawsuits

The Mirena IUD was approved in 2000 as a contraceptive, and has continued to rise in popularity since then. According to a marketing brochure distributed by Bayer Healthcare Pharmaceuticals, the IUD is now used by more than 2 million women nationwide as a means of preventing pregnancy, and also for the treatment of heavy menstrual bleeding.*

Mirena was approved for this use in 2009 by the U.S. Food and Drug Administration (FDA). That same year, Bayer came under fire for its promotion of the IUD in an FDA Warning Letter that took issue with certain misleading marketing claims that told women they would “look and feel great” using Mirena, and see improvement in their sex lives.**

Mirena lawsuits now pending in New Jersey's Bergen County litigation allege that Bayer has a history of overstating its benefits and downplaying the risk for complications resulting from spontaneous migration of the IUD. According to claims, these injuries may include but are not limited to: uterine perforations, ectopic pregnancies, organ damage and infertility, which similarly occurred after proper insertion by a healthcare provider. Mirena lawsuits point out that current labeling on the IUD only indicates that migration may result when the uterus is perforated during insertion.

Similar claims have also been filed at the federal level in a multidistrict litigation (MDL) established in the U.S. District Court, Southern District of New York. There, court documents updated in January show 1,160 Mirena lawsuit filings now centralized for pretrial proceedings. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
