According to a report from Reuters, a lawsuit has been filed against Microsoft that claims the company is tracking users of Windows Phone 7 without their consent. The lawsuit claims that Microsoft "intentionally" built the camera app to track users' locations, even if they have turned off the "feature." Microsoft previously sent a letter to Congress that stated location data is only collected with the "express consent of the user." The suit claims that this isn't the case.
The litigation, brought on behalf of a Windows Phone 7 user, claims Microsoft transmits data -- including approximate latitude and longitude coordinates of the user's device -- while the camera application is activated. It seeks an injunction and punitive damages, among other remedies.
This lawsuit comes just months after a controversy arose of how Apple tracks users' locations without them even knowing about it. In Apple's case, that data was then sent to remote servers for collection. After several hearings and a software update, the controversy seemed to have been resolved. Something similar also happened with Google's Android OS.
