Cannabis Stocks Collapse After Trump Win: Major Players See Double-Digit Declines At Wednesday's Close

The U.S. Supreme Court is grappling with a complex case involving a former truck driver, <a href="https://www.benzinga.com/markets/cannabis/24/04/38523812/ny-supreme-courts-landmark-ruling-upholds-medical-marijuana-patients-rights-under-human-rights-l">Douglas Horn</a>, who claims he was wrongfully fired after a failed drug test, which he attributes to a &#8220;CBD-rich medicine.&#8221; 
Horn is suing under the Racketeer Influenced and Corrupt Organizations (RICO) Act, a law designed to combat organized crime, seeking triple damages for what he describes as a business or property injury.
<h1 class="wp-block-heading">Divided Court: &#8216;Medical Marijuana Did Not Fire You&#8217;</h1>
The court was divided during Tuesday's arguments. Some of the conservative justices seemed wary of allowing Horn's case to move forward, <a href="https://www.cnn.com/2024/10/15/politics/cbd-trucker-supreme-court/index.html">noted</a> CNN, fearing it could lead to a surge in RICO lawsuits over routine personal injuries.
Justice Brett Kavanaugh called Horn's legal theory a "radical shift" in how tort claims are handled in the U.S., Chief Justice John Roberts also raised concerns about the broader implications of the case and Justice Clarence Thomas said, "Medical Marijuana did not fire you."
Conversely, the Court's liberal justices, led by Justice Elena Kagan, argued Horn had indeed suffered a business injury. Kagan pointed out that losing one's job could be considered a harm to one's business under the RICO law. "If you've been injured in your business, which includes your employment, then you're entitled to threefold damages," Kagan stated, <a href="https://www.nytimes.com/2024/10/15/us/supreme-court-thc-truck-driver-drug-test.html">according</a> to the New York Times.
Justice Ketanji Brown Jackson agreed. "He's not claiming that he got ill because of the product. He's not saying he was personally injured. He didn't even know that he had ingested THC until the testing and the firing."

<h1 class="wp-block-heading">What's It All About?</h1>
Horn's legal journey began in 2012 after he tried a CBD product called "Dixie X," which he believed did not contain THC, the psychoactive component in cannabis. After failing a drug test, Horn was fired. He then sued the companies behind the CBD product, including Medical Marijuana Inc. (OTC:<a class="ticker" href="https://www.benzinga.com/stock/MJNA#OTC">MJNA</a>), Dixie Holdings and Red Dice Holdings, alleging that they had engaged in a pattern of racketeering carried on through an enterprise that included mail and wire fraud.
A federal district court initially ruled against Horn, but the 2nd U.S. Circuit Court of Appeals allowed his suit to proceed.
Medical Marijuana and the other companies argue Horn's injury is personal, not a business or property harm as required under RICO. They said a ruling in Horn's favor would dramatically expand the scope of civil RICO lawsuits, turning what they described as a &#8220;garden-variety products-liability&#8221; case into something much larger.
A decision is expected next year.

Cannabis Stocks Under $2: Why Are These Small-Cap Shares Up While Broader Sector Is In The Red?

In a landmark ruling, New York state Supreme Court Justice Rebecca A. Slezak upheld a jury&#8217;s decision to award over $191,000 to a former wastewater treatment worker who was fired for testing positive for legally prescribed medical marijuana <a href="https://www.benzinga.com/topic/medical-cannabis">for chronic back pain.</a>
Despite the vigorous post-verdict legal battle to overturn or reduce the jury's verdict, Slezak ordered the city to reinstate Thomas Apholz to his job as well as pay an additional $149,107 for his legal fees.
The verdict marks the first time in New York where an employer was found to have violated the state Human Rights Law that deems someone with a legal medical marijuana recommendation as having a disability, making them part of a protected class. 
<h2 class="wp-block-heading">What Happened</h2>
Apholz, 44, was fired by the city of Amsterdam's Mayor Michael Cinquanti in 2020 after testing positive for marijuana in February 2020 during a random drug screening under a &#8220;last chance agreement&#8221; following a prior marijuana-related incident in 2017.
Despite holding a valid medical marijuana recommendation from a physician and having informed city officials that he was using it for back pain, Apholz&#8217;s dismissal went forward, <a href="https://www.timesunion.com/capitol/article/worker-fired-positive-cannabis-test-wins-another-19429082.php">reported</a> Times Union. 
"What business is it for the city to say what medicine a doctor can prescribe for an employee off duty? The city should get out of Mr. Apholz's private doctor-patient decisions and let him just do the job at which he excelled," said his attorney Kevin A. Luibrand, who praised the jury&#8217;s decision to reinstate Apholz and cover legal fees. 
Apholz&#8217;s case, which underscores the legal protection afforded to medical marijuana users and employers&#8217; obligations to accommodate them, sets a precedent in New York&#8217;s legal landscape, noted the outlet. Medical marijuana has been legal in NY since January 2016 under the Compassionate Care Act.
<h2 class="wp-block-heading">US Supreme Court Takes Up Another Case</h2>
Meanwhile, the U.S. Supreme Court has agreed to hear a case involving a trucker who sued Medical Marijuana, Inc. (OTC:<a class="ticker" href="https://www.benzinga.com/stock/MJNA#OTC">MJNA</a>) after he was fired due to testing positive for THC that he says was caused by consuming what he believed was a hemp-derived CBD product.
Douglas Horn filed a lawsuit against the cannabis company in 2015 under the Racketeer Influenced and Corrupt Organizations (RICO) Act, alleging that the company falsely advertised the product as having "0% THC" which is why he was using it to alleviate pain, <a href="https://www.marijuanamoment.net/u-s-supreme-court-takes-up-case-of-trucker-fired-over-thc-test-he-says-was-caused-by-cbd-product/">reported</a> Marijuana Moment.
While a lower court sided with Horn and allowed the RICO suit to proceed, Medical Marijuana, Inc appealed the ruling with the Supreme Court, where justices are expected to take up the case soon.

NY Supreme Court's Landmark Ruling Upholds Medical Marijuana Patient's Rights Under Human Rights Law

Shares of cannabis stocks are trading higher after VP Kamala Harris recently urged the DEA to reschedule marijuana.

Following years of stalling on the issue of legal cultivation of <a href="https://www.benzinga.com/cannabis">cannabis</a> for medicinal and industrial purposes, a Brazilian appeals court is set to rule on allowing businesses and farmers to grow&nbsp;cannabis, <a href="https://www.reuters.com/video/watch/idRCV00BX1M">reported </a>Reuters.
<h3>What Happened?</h3>
The Superior Court of Justice (STJ) made its intentions public&nbsp;to reach a final decision on a case that would set a precedent nationwide. Lawyers familiar with the case said until the court&#39;s final ruling on the matter,&nbsp;which is expected within the next year,&nbsp;pending cases filed by companies seeking to plant cannabis in Brazil&nbsp;will be frozen. In a civil lawsuit, DNA Solucoes em Biotecnologia argued its right to import seeds and plant cannabis containing higher levels of CBD and less THC.
<h3>Why It Matters?</h3>
Currently, CBD products and those containing less than 0.2% THC can be legally prescribed in Brazil. Products with 0.2% THC or more can only be prescribed for terminal patients or when patients are not responding to traditional treatments.
While Brazil greenlighted both sales and production of cannabis products, businesses are still obliged to import some of the ingredients, given that growing Cannabis sativa L is forbidden in the country, leading to high costs for the final product.
The use of medical marijuana (MMJ)&nbsp;was legalized in Brazil in 2015. For now, patients can only obtain imported MMJ products with strict authorization from ANVISA (National Sanitary Surveillance Agency). Manufacturers have to import the semi-finished product and can only operate after receiving a special certificate from the agency.
In 2019, Brazil became the third Latin American country, after Uruguay and Colombia,&nbsp;to regulate the sale of medical marijuana products.
Arthur Arsuffi, a lawyer behind the biotech start-up in the case prior to the STJ, explained why Congress is stalling on the cannabis issue.
&quot;Congress is a little afraid to decide on the cannabis issue, as it is a controversial one,&quot; Arsuffi said. &quot;So that has put off a decision and, given the number of lawsuits, the judiciary ends up having to settle the issue.&quot;

Key Marijuana Executive Changes You Should Know About, New Appointments & More

HempMeds, a subsidiary of Medical Marijuana, Inc. (OTCPK:MJNA) took part in a collaboration on a study to demonstrate the effectiveness of hemp-based CBD in the treatment of Parkinson&#39;s Disease. The company is also collaborating with the Center for Research and Advanced Studies of Neurological Diseases at the Siglo XXI National Medical Center, on a preclinical study in an animal model that demonstrated the ability to decrease extracellular glutamate levels that can lead to traumatic brain injuries.
This study, which was led by Dr. Luisa Rocha in conjunction with a large group of Mexican scientists, demonstrated the efficacy of oral administration of the company&rsquo;s proprietary RSHO CBD product in the treatment of traumatic brain injuries, generated by a reduction in the excessive release of glutamate in the cerebral cortex.
&ldquo;Through this controlled study, we were able to observe that the oral administration of cannabidiol during the seven days prior to an injury helped to avoid the over-release of glutamate that results from brain trauma, an effect associated with decreased mortality in neurons. In this study, it was also shown that the application of CBD helps sensorimotor improvement,&rdquo; Dr. Rocha stated.
Glutamate is the main excitatory neurotransmitter of the central nervous system. Abnormally high levels of glutamate lead to a process called excitotoxicity, which can lead to death of neurons.
Dr. Rocha added: &ldquo;The results obtained in this study help to understand how the oral application of cannabidiol reduces excitotoxicity caused by long-term traumatic brain injuries and facilitates functional recovery. In fact, pre-injury CBD treatment was sufficient to lessen the aftermath of traumatic brain injury.&rdquo;

Medical Marijuana Q2 Revenue Declines 18.75% YoY, Here Are The Details

Medical Marijuana, Inc. (OTC: <a class="ticker" href="https://www.benzinga.com/stock/mjna#OTC">MJNA</a>), the first&nbsp;publicly-traded cannabis company to launch cannabis-derived nutraceutical products, brands, and supply chains announced that its subsidiary HempMeds&nbsp;is collaborating with Hospital del Cruce to conduct a study in Argentina on the efficiency of CBD as a treatment for epilepsy in adults.
The Argentine Ministry of Health authorized Hospital del Cruce, the leading research center in Argentina, to import HempMeds&nbsp;products and conduct the study&nbsp;to be led by <a href="https://enys.conicet.gov.ar/dra-silvia-kochen/">Dr. Silvia Kochen</a>, a neurologist who serves as executive director of Neuroscience and Systems Studies Complexes in the Epilepsy Center&nbsp;of Hospital del Cruce. Dr. Kechen&#39;s&nbsp;work will form part of a broad scientific evidence initiative on the use of CBD for the treatment of epilepsy.
&ldquo;There is little scientific evidence in Latin America that supports the advantages of CBD as a treatment for neurodegenerative disorders, and most of the research done by other researchers focuses on pediatric patients. With this new research, we will obtain broader information that will be a valuable asset for Latin American health authorities to understand and acknowledge the potential therapeutic capabilities of CBD,&rdquo; said&nbsp;Kochen.
In addition, Medical Marijuana, Inc. will be donating its hemp-derived RSHO-X 5,000mg CBD products for the study.

<h3>What Happened?</h3>
The Sixth Panel of the Superior Court of Justice of Brazil authorized&nbsp;three people to grow marijuana for medicinal purposes, <a href="https://oantagonista.uol.com.br/brasil/decisao-do-stj-autoriza-cultivo-de-maconha-para-fins-medicinais/">reported</a> O Antagonista. &ldquo;The Superior Court of Justice decided Tuesday, June&nbsp;14&nbsp;to grant two safe conducts that advance the regulation of artisanal marijuana cultivation in Brazil.&rdquo;&nbsp;
<h3>Why It Matters?</h3>
The case should serve as a precedent for lower courts and the advance of cannabis legalization in the potentially huge market of&nbsp;200 million people. The decision contemplates the use of cannabidiol (CBD) for personal use and allows marijuana cultivation only&nbsp;for medicinal purposes, with&nbsp;a&nbsp;prescription. In addition, this gives home growers&nbsp;a legal precedent that can evolve into more comprehensive legislation as in the case of Argentina, where hemp and medicinal cannabis production are already legally produced in the country.
The use of medical marijuana was legalized in Brazil in 2015, but until now patients could only obtain imported medicinal cannabis products with strict authorization from ANVISA (National Sanitary Surveillance Agency). In 2019, Brazil became the third Latin American country to regulate the sale of medical marijuana products after Uruguay and Colombia.
Manufacturers have to import the semi-finished product and can only operate after receiving a special certificate from ANVISA. The importation of whole plants is still prohibited.
CBD products and those containing less than 0.2% THC can be prescribed normally. Products with 0.2% THC or more can only be prescribed for terminal patients or in cases where the patient is not responding to traditional treatments.
&ldquo;Achieving cannabis regulation through (ANVISA) could imply that Brazil becomes a key player in the Latin American cannabis market, not only because of its geographic and climatic diversity but also because of how significant the market would be for the Brazilian population,&rdquo; <a href="https://www.benzinga.com/markets/cannabis/19/12/14924387/brazil-regulates-sale-of-medical-marijuana-products?__hstc=99187265.fb757cbcb99f3c006a237d5eac7140ad.1643976817119.1655226675221.1655239461069.401&amp;__hssc=99187265.11.1655239461069&amp;__hsfp=3318245074">said </a>Silvia Mu&ntilde;oz, former head of Government Affairs for LATAM at the International Cannabis and Cannabinoids Institute in the Czech Republic during an interview a few years ago.
<h3>Which Cannabis&nbsp;Companies Are Already In Business In Brazil?</h3>
MediPharm Labs Corp. (TSX: LABS) (OTCQX: <a class="ticker" href="https://www.benzinga.com/stock/medif#OTCQX">MEDIF</a>) confirmed in September 2021 a partnership with, XLR8 BRAZIL, a distributor based in Rio de Janeiro. This latest move will strengthen the company&#39;s delivery services to the largest medical cannabis market in Latin America.
The two-year agreement would start from the authorization of the product. Pursuant to it, MedPharm Labs chose to provide a wide range of cannabis concentrate formats for the formulated products that XLR8 BRASIL will subsequently distribute.
