Hamilton County Indiana Superior Court Lawsuit Dismissed Against Shmulik Fishman

NEW YORK, June 18, 2019 /PRNewswire-PRWeb/ -- On June 4, 2019, the Hamilton County Indiana Superior Court dismissed a civil lawsuit brought by STRATIM Systems, Inc. and Adesa, Inc. against Shmulik Fishman, STRATIM's former co-founder and COO (Case # 29D04-1812-PL-011774). STRATIM is a mobility services company based in San Francisco, California.

The Court dismissed all claims, including breach of fiduciary duties and fraud. In dismissing the case, the Court ruled that any action between Fishman and his former employer would need to proceed in California, where Fishman worked for STRATIM, because "they previously agreed to litigate in California."

"It is with a profound sense of relief that I learned last week that a lawsuit brought in the State of Indiana, a place where I was a nonresident and had no contacts, ties, or relations was dismissed by the Hamilton County Superior Court," said Fishman.

In February, Fishman initiated an action in Superior Court for the State of California, County of San Francisco, against STRATIM and its parent corporation, KAR Auction Services, Inc. alleging, among other things, compensation due under an employment agreement, which he asserts was due to him following his resignation from STRATIM in late 2018 (Case # CGC-19-574195). STRATIM and KAR have filed a counterclaim on Fishman's action. The suit is still active.
