Settlement Administrator Announces Proposed Settlement in the Ferrara Candy Co Litigation

PR Newswire

WEST PALM BEACH, Fla., July 26, 2018 /PRNewswire/ -- The following is issued by Digital Settlement Group.

There is a lawsuit pending in the U.S. District Court for the Northern District of California that may affect your rights. The lawsuit claims Ferrara Candy Co. deceptively packaged Jujyfruits®, Jujubes®, Now & Later®, Lemonhead®, Applehead®, Cherryhead®, Grapehead®, RedHots®, Trolli®, Chuckles®, Black Forest®, Jawbuster®, Jawbreaker®, Brach's®, Boston Baked Beans®, Super Bubble®, Rainblo®, Atomic Fireball®, and any flavors and varieties of those candy products ("Settlement Class Products") in oversized packaging with nonfunctional empty space. Ferrara Candy Co. denies the claims in the lawsuit. The Court did not rule in favor of Plaintiff or Defendant. The parties instead agreed to settle.

The Settlement Class includes all persons residing in the United States who purchased one or more Settlement Class Product between February 21, 2013 and June 21, 2018. Subject to Court approval, the settlement provides cash payments based on the number of Settlement Class Products purchased. Class members with proof of purchase may submit a claim for 50 cents per box for each Settlement Class Product purchased. Class members without proof of purchase may submit a claim for up to $7.50. These amounts will be increased proportionally (pro rata) if the total amount of claims does not exhaust all settlement funds or reduced pro rata if the total amount of claims exceeds the settlement funds. The settlement also provides for modification of Ferrara's fill level quality control procedures and target fill levels.

You have a choice about whether to stay in the Settlement Class or not, and you must decide by September 20, 2018.  Your options are described in greater detail at http://www.ferraracandysettlement.com and include:

You Can Accept the Settlement:  If you wish to receive a Cash Payment, you must submit a Claim Form on or before September 20, 2018.

You Can Object to the Settlement:  You must file your objections in writing with the Court on or before September 20, 2018.

You Can Opt-Out of the Settlement: You can exclude yourself from the Settlement Class by sending a written notice to Digital Settlement Group on or before September 20, 2018.

Do Nothing:  You will receive no cash payment from the settlement but you will be bound by the settlement and any orders or judgments of the Court.

For more information about each option, instructions and mailing addresses for each option, and to view the settlement documents, please visit http://www.ferraracandysettlement.com, email the Settlement Administrator at info@FerraraCandySettlement.com, or call the Settlement Administrator at 1-877-452-8477. This is only a summary of the settlement.

THE FAIRNESS HEARING is scheduled for October 25, 2018, at 10:00 am, at the United States District Court for the Northern District of California.
