Cambridge Security Seals Wins Court Battle With TydenBrooks


According to Court Documents, Federal Appeals Court Refuses to Affirm Damages Theory

Cambridge Security Seals ("CSS") has won the latest round of its litigation with TydenBrooks. In a decision handed down on Monday June 5th, 2017, the U.S. Circuit Court of Appeals for the Second Circuit refused to affirm the disputed judgment against Cambridge Security Seals ("CSS") in E.J. Brooks v. Cambridge Security Seals, 16-207-cv(L). According to court documents, the three-judge panel unanimously agreed that TydenBrooks' judgment is based on a theory of damages that is not recognized under New York law, and sent the matter to the New York Court of Appeals, which will decide whether the judgment must be vacated in its entirety.

The plaintiff, owned for more than a decade by Crimson Investments, sued CSS, a startup, in 2012 for misappropriation of trade secrets and unfair competition after CSS began manufacturing seals in the U.S. to compete with manufacturers who offshore much of their production to China and other low-wage countries.

According to court documents, rather than overturn the verdict, the Federal Appellate Court refused to affirm the award, declaring: "In short, neither our Court nor the New York courts appear to have approved the specific type of award in this case."
