Attorney Jared W. Beilke Wins $628,986.41 for Client in Personal Injury Case

California trial attorney Jared W. Beilke, of JML Law, and co-counsel Cathryn Fund, win a substantial verdict for a client who fell into a storm drain that was in violation of city standards.

Attorney Jared W. Beilke, a partner at JML Law, and co-counsel Cathryn Fund, recently won a personal injury case (Case no. CIVDS1312618 filed in San Bernardino County Superior Court) for a client (plaintiff) who stepped off a traffic island in Yucca Valley into a storm drain. The plaintiff, a former Marine, received a total verdict of $838,648.55, which was reduced by 25% to $628,986.41 for contributory negligence (assumption of risk for walking over the traffic island) on the part of the plaintiff.

According to court documents, the plaintiff stepped off the island into the slope of a storm drain that was 13 inches in height and almost quadruple what the Yucca Valley standards allow for such storm drains. As a result, she fell and broke her ankle in multiple places, which required surgery including a metal plate and 13 screws. The plaintiff was placed in a moon boot and required home care services from her family, a nurse and a physical therapist. She was eventually cleared to drive and return to work one year after the fall.

Court documents allege that during the entire six years the defendant owned the property they never did any inspections for dangerous conditions, nor did they follow up with their property manager or require him to conduct such inspections. The storm drain, according to court documents, was in violation of the Yucca Valley standards and the defense expert could not deny this.
