Dog Bite Attorney Responds to Announcement that Farmers Insurance Will Limit Dog Bite Compensation


Farmers Insurance has announced that it will no longer compensate CA policyholders for certain dog bites. Dog bite attorney Jeff Nadrich responds.

Farmers Insurance Group has announced that it will no longer provide financial compensation to California policyholders who suffer dog bites at the hands of certain breeds, according to a report by NBC Los Angeles. Specifically, the policy change impacts pit bulls, Rottweilers and wolf breeds. As the CDC reports, these breeds are responsible for the most reported dog bites nationwide.

NBC released a statement from Farmers spokeswoman Erin Freeman, which reads, “We reviewed our liability claim history and we determined that three breeds accounted for more than 25% of dog bite claims. In addition, these three breeds caused more harm when they attacked than any other breed.”

Some pit bull activists are criticizing the move. Candy Clemente, who trains pit bulls for the Animal Planet show Pit Boss, called the move “offensive,” telling NBC, “They are condemning these breeds indiscriminately without giving the home owners a chance to prove their dogs are not vicious."

The change is set to take effect as Farmers policyholders renew their policies. Jeff Nadrich, A Los Angeles dog bite attorney, recently responded to the news. Nadrich is referring to California Civil Code Section 3342, which specifies that “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner's knowledge of such viciousness.”
