Judge Continues Restraining Order Against Dallas TV Station WFAA and Reporters: Dr. Richard Malouf
A judge has continued a temporary restraining order against various media brought by Dr. Richard Malouf of Dallas, Texas
Dallas, TX (PRWEB) November 05, 2012
Judge Sally Montgomery, of Dallas County Court at Law No. 3, continued a temporary restraining order (Dallas County Court at Law #3 case no. CC-12-06268-C) today against Dallas TV station WFAA-TV, its investigative reporter Byron Harris and real estate blogger Candace Evans.
All are banned from “physically invading or entering onto the real property of Dr. Richard Malouf and Leanne Malouf” located on Strait Lane in Dallas, and “capturing images of the Residence including the Residence backyard, side yard, front yard, from within the Residence or overhead whether digital, video, still, motion, film or otherwise.”
The decision comes as a result of Dr. Malouf filing suit (Dallas County Court at Law #3 case no. CC-12-06268-C Original Petition) against the trio for alleging trespass, invasion of privacy, defamation, libel, slander and conspiracy in conjunction with WFAA's year-long media crusade against Dr. Malouf, a successful Dallas dentist who founded and sold his 51-office chain of All Smiles Dental Clinics in 2010. Included in the suit are Belo Inc., WFAA-TV's parent company, and Laura Wilson, Malouf's next door neighbor.
The suit alleges that Evans trespassed the grounds of the Malouf property to take photographs for her blog, invaded a family birthday party on the grounds of the home and attempted to interview the Malouf's minor daughter before she was spotted and asked to leave, attempted to bribe construction workers working on the Malouf home for information about the Maloufs and their home, and conspired to have a hidden camera placed in the bedroom closet of Mrs. Malouf.
WFAA, Belo and Harris are alleged to have also infringed on the privacy rights of the Maloufs and for making numerous false, misleading and damaging remarks about Dr. Malouf's business interests and financial health.
“I am happy that my family can now continue their lives at home in a more normal fashion until this case can be tried,” stated Dr. Richard Malouf.
