Phoenix Resident Settles Injury Claim Against Property Owner for Failure to Maintain Premises for $420,000.00

This case has been settled out of court. Irma Boggio, a Phoenix resident, settled a personal injury claim against Achuldjian, LLC for four hundred twenty thousand dollars ($420,000.00) for injuries she sustained when she tripped over a ten inch piece of metal rebar sticking out of the parking lot on the property at a Mountain Park Health facility. In December 2010, Irma Boggio was walking her dog near a Mountain Park Health facility, located at 4616 North 51st Avenue in Phoenix, Arizona. As she was walking through the parking lot, she tripped over an exposed piece of iron rebar protruding approximately ten inches from the concrete causing her to fall face-first into a curb (according to Claim #EMM4832).
Irma Boggio was immediately taken to Maryvale for emergency treatment. After evaluation, Ms. Boggio was diagnosed with a facial laceration, broken nose, broken left elbow, and disc protrusions. Ms. Boggio required three reconstructive surgeries to manage the pain in her face and minimize the scarring from the facial lacerations. Despite the reconstructive surgery, Ms. Boggio still has significant scarring on her face from the facial lacerations and broken nose (according to Claim #EMM4832).
The Law Offices of Michael Córdova asserted personal injury claims on behalf of Irma Boggio against Achuldjian, LLC, the owner of the parking lot. The law firm argued the property owner was negligent when it failed to ensure the parking lot was in a safe condition for the public to walk through it. In addition, the law firm argued the property owner was negligent in failing to warn, or at least, cordon off the dangerous condition on the property (according to Claim #EMM4832).
Ultimately, the parties resolved the claims without filing a lawsuit. In September 2012, Ms. Boggio received $420,000.00 in exchange for a release of liability against Achuldjian, LLC.
