Fox Copyright Suit Vs. DISH Hearing Set For July 7 In Wake Of Aereo Ruling

Twenty-First Century Fox FOXA will ask a federal appeals court to order a preliminary injunction in its copyright infringement suit against DISH Network DISH.

Fox's request was denied in September 2013; an appeal is set for July 7.

Fox is hoping last week's Supreme Court decision outlawing streaming TV service Aereo will add firepower to its case.

“Dish has repeatedly raised the same defenses as Aereo, which have now been rejected by the supreme court,” attorneys for Fox wrote in a court brief reported by The Guardian.

DISH faces a similar suit brought by CBS CBS and says "it may be subject to substantial damages" if it can't prevail. The CBS case may go to trial in April 2015.

"We cannot predict with any degree of certainty the outcome of these suits or determine the extent of any potential liability or damages," DISH added in its most recent quarterly filing with the SEC.

DISH traded recently at $65.31 per share, down 0.5 percent. Its 52-week high on Friday was $65.75.
