CLINIPRO, Spanish manufacturer of medical-aesthetic devices announces that as a result of the lawsuit filed by Zeltiq Aesthetics Inc.
ZLTQ
along with the Massachusetts General Hospital (MGH) against CLINIPRO for alleged patent infringement, the Barcelona Mercantile Court no.5 issued an Order dated June 25, 2012, accepting the provision of an alternative security by CLINIPRO which substitutes preliminary injunction agreed at previous Order of May 5, 2012 preventing any act of marketing the LipoCryo device in Spain. On the occasion of prior Order of May 5, 2012, Zeltiq issued several releases, causing confusion in the industry and among public opinion, stating that all LipoCryo devices sold in Spain had been withdrawn from the market -something that never happened- and that the same would happen in other countries where LipoCryo is being marketed successfully. Now the situation is clear because according to the Order of June, 5, 2012, CLINIPRO can continue manufacturing, offering, advertising and marketing the LipoCryo device in Spain without any restriction and without involving any infringement neither for the manufacturer nor for the distributor.
