Jerry Stouck, litigation shareholder in international law firm Greenberg Traurig, LLP's Washington, D.C. office, will speak at the 18th Annual Conference on Litigating Takings Challenges to Land Use and Environmental Regulations. Specifically, Stouck will appear on a panel discussing "Reorganization Takings" from 10:30 a.m. – 11:45 a.m. Friday, Sept. 25, at the University of Maryland Francis King Carey School of Law in Baltimore, Maryland. He will speak alongside Nestor M. Davidson of Fordham Law School and Kenneth M. Dintzer of the U.S. Department of Justice.

According to their website, the conference explores the takings issue as it relates to land use, environmental rules, and other forms of economic regulation. In addition to offering a basic education in modern takings law, the conference brings together a diverse group of leading scholars and experienced practitioners to discuss cutting-edge issues. Stouck's panel will address novel takings claims arising from the 2008 financial crisis, and his talk will specifically address litigation against the government brought by shareholders of Fannie Mae and Freddie Mac.

Some of the topics to be discussed include the practical implications of the U.S. Supreme Court's recent takings decisions and pending takings issues before the Maryland Court of Appeals. The conference will also address the significance of the Supreme Court decision in Kelo v. City of New London on the 10th anniversary of that controversial case. Other issues to be discussed include potential takings issues arising from government efforts to deal with flooding and other disasters, local government access to insurance against takings claims, and novel takings claims based on the theory that property owners have an entitlement to regulatory protections.

Stouck has a wide-ranging trial and appellate litigation practice. He has particular experience in complex business, regulatory, and environment disputes with government agencies. Stouck regularly handles environmental and land use litigation, including related contract/commercial disputes, and has extensive experience with eminent domain and Fifth Amendment regulatory takings claims. He appears frequently in the U.S. Court of Federal Claims and Federal Circuit, and in the D.C. federal district court and D.C. Circuit.
