The San Francisco Labor Law Lawyers at Blumenthal, Nordrehaug & Bhowmik Sue Thinktank Learning Claiming That Their Admissions Consultants Were Not Paid Overtime Wages

The putative class action complaint alleges that the college admissions consulting firm failed to provide their Admissions Consultants with overtime wages as a result of allegedly improperly classifying these employees as "exempt" from overtime pay and meal breaks

The class action lawsuit was filed by the San Francisco employment attorneys at Blumenthal, Nordrehaug & Bhowmik on July 6, 2015. The lawsuit claims that Thinktank Learning, Inc. misclassified their Admissions Consultants in order to avoid paying these employees overtime wages and providing them thirty (30) minute meal breaks. The Thinktank Learning class action lawsuit, Case No. 115CV282698, is currently pending in the Santa Clara County Superior Court for the State of California. The Complaint alleges that the Admissions Consultants employed by Thinktank Learning in California were improperly classified as exempt from receiving overtime pay and related benefits, such as meal and rest breaks.

The class action lawsuit claims that the Admissions Consultants engaged in a finite set of non-exempt tasks throughout their shift, including attending mandatory monthly meetings with all student clients, meeting with student clients and their parents as needed, researching and writing articles, checking applications and steps in the process ensuring completion, engaging in academic counseling during non-application season (February to July), executing orders given to them by Lead Admissions Consultants and Consulting Managers, providing regular reports and updates to Consulting Managers and Center Managers, assisting the Center Manager in tasks relating to PCAP consulting clients (marketing, sales, service), and participating in weekly meetings all in accordance with Thinktank's company policies.

The Thinktank Learning lawsuit also claims that the Admissions Consultants spent no time supervising other employees working for the college admission consulting firm. As a result, the lawsuit alleges that the Admissions Consultants were misclassified and therefore should have been paid overtime wages and should have been provided thirty (30) minute uninterrupted meal periods.

According to the lawsuit, Thinktank Learning is a college admissions consulting firm founded by Steven Ma that offers basic subject tutoring and SAT/ACT prep to college consulting.
