FourKites Files Motion to Dismiss Macropoint's Patent Infringement Suit

FourKites, Inc., the next generation provider of truckload tracking services, has become aware that MacroPoint LLC filed a patent infringement lawsuit in the U.S. District Court for the Northern District of Ohio.

FourKites, Inc., the next generation provider of truckload tracking services, denies the allegations levied by MacroPoint LLC in a patent infringement lawsuit filed in the United States District Court for the Northern District of Ohio, Case No. 15-cv-1002. The lawsuit asserts infringement of MacroPoint's U.S. Patent No. 8,604,943 entitled, "Systems and Methods for Monitoring Location of Freight Carried by a Vehicle." FourKites is aggressively defending its freedom to operate, as reflected in the motion to dismiss it filed last week that challenges the subject-matter validity of the '943 patent.

As stated in FourKites' motion to dismiss, "the '943 patent claims the idea of tracking freight using a computer," and "[t]he mere idea of tracking freight is not patentable." FourKites' motion denounces "improvidently granted patents" that "amount to nothing more than stating an idea and saying ‘apply it' to a computer." FourKites' motion states that the '943 patent is "such a patent," and urges the District Court to find the '943 patent invalid under 35 U.S.C. § 101 and the Alice progeny of cases.

FourKites' motion also contends that "FourKites does not infringe the '943 patent, and the claims of the '943 patent are invalid as anticipated and obvious." As stated in FourKites' filing, "[r]emote tracking systems like that claimed in the '943 patent were well-known in the industry and publicly available for years prior to the filing of the '943 patent." Nonetheless, because FourKites' motion contends that "[s]ubject-matter eligibility is a threshold question that should be resolved at the first opportunity," its motion asks that the Court enter an order "finding all the claims of United States Patent No. 8,604,943 invalid as directed to patent ineligible subject matter under 35 U.S.C. § 101 and dismissing MacroPoint, LLC's Complaint with prejudice."
