According to court documents, Johnson & Johnson and its DePuy Orthopaedics unit are facing some 6,000 lawsuits that allege the all-metal hip caused recipients to suffer serious and debilitating complications. According to court documents, Pinnacle hip lawsuits pending in Texas allege that the metal-on-metal version of the implant was defectively designed, and can cause metal debris to leech into a patient's blood stream. The resulting build up of toxic chromium and cobalt ions can result in the development of metallosis (metal ion poisoning), chronic pain, and other complications that may lead to premature failure of the device.

The Plaintiff in the proceeding's first bellwether trial underwent revision surgery within two years of receiving the Pinnacle hip allegedly as a result of similar complications, including cobalt blood serum levels 85 times higher than normal. Court papers filed by the Plaintiff's attorneys assert that jurors could award more than $5 billion in punitive damages if they decide that the defendants should be punished for their alleged mishandling of the device. In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits.* The companies' announcement followed an alert issued by the U.S. Food & Drug Administration (FDA) in January of that year that warned metal-on-metal hips were more likely to fail early than those made of other materials. The agency also disclosed that it was considering new rules that would subject all-metal hips to greater regulatory scrutiny.
