A leading national law firm is warning families to act fast and register their claims for wrongly paid care home fees before the March 31 deadline.
Moore Blatch Resolve says it's a common misconception that anyone living in a nursing or care home because of health requirements has to pay their own fees.
A Court of Appeal ruling in 1999 established that all medical or nursing care required due to ill health should be fully funded by the NHS.
Despite this, many families are still paying for a relative's care, and for some they have had to sell property or lose savings in order to afford the fees. A number of families may even be wrongly paying ‘top up fees' where a local authority is meeting part of the cost.
Solicitor Paula Nash explains, “There is a deadline approaching for those eligible to reclaim care home fees paid since April 2011, so there's little time to waste. In simple terms, if someone has spent time in a nursing or care home due to a primary health need, the fees should have fallen to the NHS.
The same could also apply where a person has been paying for care at home if they satisfy relevant criteria and can demonstrate a primary health need.
“We have dealt with a number of claims already, which can often run into tens of thousands of pounds or more. Families who have paid these fees in error will not be able to submit a claim once the deadline has passed, so I would urge them to seek legal advice quickly.”
Claims can arise from a wide variety of medical conditions, relevant to physical or mental health, and can still go ahead even if the person who received the care has since passed away.
