United States Court of Appeals Affirms SVS Victory over Card Activation Technologies

Ceridian Stored Value Solutions (SVS) announced today that a panel of the United States Court of Appeals for the Federal Circuit has affirmed SVS's 2011 declaratory judgment victory against Card Activation Technologies, Inc. (CAT). The Federal Circuit's ruling is another step in SVS's efforts to protect its customers from threats of litigation by CAT.

Ceridian Stored Value Solutions (SVS) announced today that a panel of the U.S. Court of Appeals for the Federal Circuit has affirmed SVS's 2011 declaratory judgment victory against Card Activation Technologies, Inc. (CAT). The U.S. District Court for the District of Delaware in Case No. 09-CV-0495 is another step in SVS's efforts to protect its customers from threats of litigation by CAT.

The Federal Circuit panel agreed with a summary judgment decision of Judge Kent A. Jordan of the U.S. Court of Appeals for the Second Circuit, sitting by designation in the U.S. District Court for the District of Delaware, that the claims of CAT's U.S. Patent No. 6,032,859 were invalid. The appellate ruling fully vindicates SVS's position that its gift cards and related services do not infringe any valid patent. CAT argued on appeal that the district court erred in finding that the prior art anticipated a step in CAT's method for processing gift card transactions, and that the written description of the method failed to disclose an element of the claimed invention. The Federal Circuit panel rejected each of CAT's arguments.

SVS filed the underlying lawsuit in 2009, seeking to invalidate all of the claims CAT's patent, because CAT had previously sued a number of SVS customers asserting that SVS's card products infringed the patent.
