Wright & Schulte LLC reports today that DuPont and Argus filing class actions have reached a settlement agreement whereby property owners participating in DuPont's Imprelis claims process will be included in the class action settlement agreement currently awaiting court approval in Pennsylvania federal court. Thousands of Imprelis lawsuits are currently pending in U.S. District Court, Eastern District of Pennsylvania on behalf of property owners who sustained damage to landscape trees, allegedly due to DuPont's now-recalled Imprelis herbicide. Any Imprelis claimant dissatisfied with the proposed settlement agreement must opt out if they do not wish to be included in the settlement class. Imprelis herbicide was introduced by DuPont in October 2010 and marketed as a safe and effective way to treat the most common and hard to kill broadleaf weeds without any negative impact on surrounding plants. However, after investigating hundreds of reports of Imprelis tree death throughout the Northeast and Midwest U.S., the U.S. Environmental Protection Agency (EPA) issued a Stop Sale and Removal Order for Imprelis in August 2011. By that time, the EPA had received 7,000 reports of Imprelis tree damage and death from DuPont.
