With growing budget deficits, many states are taking increasingly aggressive positions in an attempt to impose sales and use tax obligations on internet transactions. Internet sellers face a murky and sometimes ill-defined landscape with respect to sales and use taxes that are impacted by both state law and federal constitutional principles. Therefore, Tax Professionals' Resource is excited to host a tax compliance audio conference to help internet sellers better understand their sales and use tax obligations and ensure compliance.

The live audio conference, titled “Sales and Use Tax Issues of Internet Transactions,” will take place on November 15th from 1:00 – 2:30 pm ET and will be presented by Frank Crociata and Pat Derdenger from Steptoe & Johnson LLP of Phoenix, AZ.

By exploring the growing body of judicial decisions, this live audio conference will help internet sellers better understand their sales and use tax obligations and ensure compliance. Mr. Crociata and Mr. Derdenger will explain the constitutional requirements that must be satisfied in order for a state to impose sales or use tax obligations. They will also examine the critical substantial nexus requirement and clarify the contours of that requirement through a discussion of existing and developing case law. This live tax compliance audio conference will also explore how internet sellers can, without careful planning and analysis, establish nexus through either related or unrelated third-parties.

Frank Crociata is an associate in the Tax group in the Phoenix office of Steptoe & Johnson LLP. His practice focuses on state and local taxation. Mr. Crociata has significant experience advising retail and remote vendors on nexus establishing activities, advising multistate businesses on sales and use, income, and property tax compliance and has developed an expertise in federal and state fuel excise taxes.

Pat Derdenger is a partner in Steptoe & Johnson LLP's Tax group. His practice emphasizes federal, state, and local taxation law. His practice also covers the e-commerce industry, advising clients on their multi-state and international income tax responsibilities and their multi-state sales tax and use tax collection obligations. Mr. Derdenger has been listed in The Best Lawyers in America since 1995 (published by Woodward/White, Aiken, SC) and has been listed in Southwest Super Lawyers for State, Local, and Federal Taxation since 2007.
