The Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA) set forth reporting requirements for applicable claims involving Medicare beneficiaries where, on or after July 1, 2009, there is a settlement, judgment, award or other payment that constitutes payment or reimbursement for medical costs. Compliant reporting with quarterly submissions is required for the first time in 2010. Enforcement penalties of $1,000 for each day of noncompliance related to each claimant can become quite substantial very quickly. Failure to report just one Medicare beneficiary for only one quarter results in up to a $90,000 fine.
