Everyday Health Responds to Lawsuit Filed by WebMD

yesterday received notice of a lawsuit filed by WedMD LLC

in the U.S. District Court for the Southern District of New York, alleging trademark infringement, false advertising and unfair competition related to certain of Everyday Health's search engine keyword marketing efforts. The complaint seeks a permanent injunction barring Everyday Health from continuing to engage in the alleged keyword marketing activities, unspecified damages and attorney's fees. Based on a review of the complaint, Everyday Health believes that the claims do not have merit. Furthermore, the claims relate to only a small portion of the company's search engine marketing efforts – the campaigns referenced in the complaint relate to a very immaterial portion of Everyday Health's overall traffic and a very immaterial portion of the company's revenue.
