Victory for Garmin® in First Inter Partes Patent Review

announced today that the United States Patent and Trademark Office (USPTO) issued a final decision in the inter partes review (IPR) initiated by Garmin against a patent held by Cuozzo Speed Technologies LLC. The USPTO ordered cancellation of each of the claims under review and concluded that Cuozzo's patent could not cover LCD technology like that employed by Garmin. The USPTO's decision is subject to appeal. Cuozzo had previously filed a lawsuit in New Jersey federal court alleging that Garmin's popular nüvi® personal navigation devices infringed Cuozzo's speedometer patent. “Garmin has a long history of fighting bogus patents and we are pleased to be the first company to file an inter partes review,” said Andrew Etkind, Garmin's vice president and general counsel. “The IPR process provides a quick and efficient method to kill invalid patents in contrast to the years of litigation required to reach the same conclusion through the federal courts.
