Why not Structure the Health Care Mandate as a Discount Instead

Right now the president's bill is facing a court challenge by mandating that everyone will buy insurance, or else pay a fee.

Instead,why not just structure it as an insurance discount. If you've had insurance the last x years, you get a x% discount. You can structure the amount so that "free riders" would pay an amount greater or equal to the penalty for non compliance with the mandate.
Same effect--with one version getting struck down as unconstitutional versus the other not.
The bill as written is going to make costs rise, not cut them. I would prefer the bipartisan Wyden Bennet bill both dems and republicans support it. We should just do that bill instead. Far better.
